Like so many questions the answer is "it depends."Missouri is a marital rights state, so if you buy a home while you are legally married, your spouse has rights to that property even if you have been separated for years. But, if your spouse is willing to sign a form from your bank/ title company relinquishing their marital rights you can move forward with your sale/purchase without them being involved further. There is a lot to dealing with a divorce or separation and I always recommend consulting an attorney before committing to a major legal or contractual obligation.
